Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The passage of this legislation creates no additional costs to the WV Regional Jail and Correctional Facility Authority however, it will save the counties approximately $2.5 million in jail fees.
We have approximately 300 inmates in our jails serving an average of thirteen (13) months prior to going to trial. Since this legislation will effectively reduce the required time of going to trial from three(3) terms of court to one term, the average length of stay for pre-trial inmates will be reduced from thirteen (13) months to seven (7) months. Thus, resulting in a $2.5 million savings to the counties.
It should be noted that much of this billing will then be transferred to the WV Division of Corrections, although it won't be dollar for dollar because of offenders who will receive probation plus time served and other alternative sentencing. Also, with these offenders starting their sentences earlier, they will be able to make parole earlier, which is another reason that this is not a dollar for dollar swap.
