Effect this measure will have on costs and revenues of state government.


The stated purpose of this bill is to provide for the transfer of the Governor’s Office on Technology to the Department of Administration; for the transfer of duties of the Governor’s Cabinet on Children and Families to the Department of Health and Human Resources; for the elimination of the Governor’s Cabinet on Children and Families; for the elimination of the Center for Professional Development; for the reorganization and restructuring of the West Virginia Educational Broadcasting Authority; for the modification of the term of the Chief Administrative Law Judge of the Office of Tax Appeals; and for the Governor to have the authority to appoint two administrative law judges to the Office of Tax Appeals. There would be no additional administrative costs for the Office of Tax Appeals associated with this bill.

There would be no additional administrative costs for the Office of Tax Appeals associated with this bill.



Memorandum


The stated purpose of this bill is to provide for the transfer of the Governor’s Office on Technology to the Department of Administration; for the transfer of duties of the Governor’s Cabinet on Children and Families to the Department of Health and Human Resources; for the elimination of the Governor’s Cabinet on Children and Families; for the elimination of the Center for Professional Development; for the reorganization and restructuring of the West Virginia Educational Broadcasting Authority; for the modification of the term of the Chief Administrative Law Judge of the Office of Tax Appeals; and for the Governor to have the authority to appoint two administrative law judges to the Office of Tax Appeals. The bill changes the Chief Administrative Law Judge’s appointment from six years to four years. There is a question as to whether the four-year term restriction begins with passage of this bill or when the current six-year term ends. The bill also repeals authorization for the Chief Administrative Law Judge to employ up to two administrative law judges and instead authorizes the Governor to appoint up to two administrative law judges. There is question as to how this appointment power will actually function since the administrative law judge positions will remain in the classified service.
