Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years.



Memorandum


House Bill 2785, if enacted, adds a new article to the W. Va. Code called the West Virginia Medical Loss Ratios for Dental (DLR) Health Care Services Plan Act. HB2785 would require the OIC to contract out for any website design and maintenance to make a searchable database to report plan DLRs. There is an alternative list to report the data to an already created All-Payers Claims Database (APCD), but WV does not have an APCD. The OIC believes HB2785 would increase expenses of the OIC to obtain the services of an actuarial firm to assist with the review of certain DLR reports but we are unable to estimate the increased expenses accurately at this time. The OIC cannot define terms through a legislative rule by July 1, 2025 as required by the proposed W.Va. Code 33-64-3((4)(B). The earliest a legislative rule could be approved would be the Regular Legislative Session for 2026, and the requirement for a rule by July 1, 2025, as noted, conflicts with the proposed W.Va. Code 33-64-6, which requires the OIC to propose a rule by July 28, 2025. Also, in the proposed 33-64-5(e), the reference to calendar year 2026 after September 1 seems to be in error.
