This bill is not expected to have an impact on DOH revenues or expenses.
Memorandum
While this bill should not have an impact on Division of Highways funding, Section 10 has verbiage that could be problematic. DOH roadways typically cross railroad rights of way by easement, and therefore, the underlying property rights are still owned by the railroad and not managed by the DOH in the same manner as DOH rights of way. A permit from DOH would not automatically give the applicant the right to cross railroad right of way.
DOH is willing to cooperate with broadband companies and the railroad to facilitate the broadband expansion projects.
