Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The intent of this bill is to require the WV Division of Highways (DOH) to develop performance standards and criteria to measure agency performance in all essential operations. Additionally, it mandates the implementation of a management information system with a public interface that will track the Division’s past and current progress in meeting these performance standards. The DOH does not have the capability to adhere to all the requirements outlined in the bill without hiring a consultant. The majority of the requirements in the bill are common practice for the DOH following the independent audit in 2016.

Explanation of above estimates (including long-range effect):
The DOH would need to hire a consultant at a cost of approximately $1.5 million initially. There would also be an annual personnel expense totaling approximately $700,000. The original fiscal note estimates only factored in the initial cost of hiring a consultant. The actual cost associated with this bill would need to reflect the ongoing cost of retaining the consultant to comply with the bill. In order to implement the requirements outlined in the bill, the Division of Highways will need to engage a consultant for the following key activities: 1. Setup of Performance Management Framework: The consultant will assist in establishing the overall framework for the performance management mechanism. 2. Development of Public Interface: This includes the creation of a public-facing interface to make performance data accessible. 3. Staff Training: The consultant will provide training to staff members on the data collection process, communication protocols, and how to effectively update the system. 4. System Maintenance and Reporting: The consultant will also be responsible for establishing a reporting dashboard and outlining the processes for regularly updating and maintaining the system.
The DOH estimates the ongoing year to year costs of having a vendor collect the pavement condition data for the entire paved state road system at 5.2 million yearly. DOH collected this level of data in calendar year 2024 and this number reflects the added cost incurred. Because the known cost was based on a calendar year, this updated fiscal note splits that cost between fiscal years.
