Effect this measure will have on costs and revenues of state government.


Passage of HB3217 would require a public notification of any reported spill or discharge of any hazardous substance into the waters of the state. The DEP "Report a Spill or Accidental Discarge Hotline" received 3,733 calls during 2024. The cost of each public notification is expected to be from $75 to $100, making the agency's expected annual cost to be in the range of $280,000 to $373,300. This bill does not provide a source of revenue to offset these costs, therefore the agency would be required to absorb these costs with existing revenue sources.

Explanation of above estimates (including long-range effect):


During FY2025, the expected publication costs would be $93,325, being incurred during the final quarter of FY2025. For future years, the estimated maximum potential cost of $373,300 is used (3,733 reported spills x estimated maximum cost of $100 per public notice).



Memorandum


Due to the quantity of hazardous environmental spill notifications required under this bill, there is an increased risk of all public service notifications being ignored. The public may become desensitized due to an average of ten spill announcements per day.
