Summarize in a clear and concise manner what impact this measure will have on costs and revenues of state government. This would have a major impact on the WVDCR and also the Department of Administrative Services. There is currently no mechanism to determine the populations and areas of arrest. We estimate the cost of approximately 9.1 million.

Explanation of above estimates (including long-range effect):


Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years. Today, in our custody the WVDCR has 682 misdemeanors, both pretrial and convicted. The WVDCR cost per day at our Regional Jail is $73.07. That equates to $49,833.74 a day and $18,189,315.10 per year. Not knowing the exact percentage of payment based on the multiple equations outlined in the bill, I used %50 as a baseline to calculate the cost of the WVDCR. That total would be $9,094,657.55 per year. This total would increase each year with inflation and medical costs which generally drive our costs higher. Included in this fiscal note is the Staffing need that would occur for DAS, Division of Administrative Services. Our discussions show at least (2) additional staff would be needed for invoicing/billing. $70,000.00 per staff to include benefits at that agency.

Please identify any areas of vagueness, technical defects, reasons a bill would not have a fiscal impact, and/or any special issues not captured elsewhere on this form. It is extremely difficult to calculate an amount because of the numerous variable calculations . The purpose of this bill is to require the Commissioner of the Division of Corrections and Rehabilitation to pay jail bills for the incarceration of inmates incarcerated for a misdemeanor. There are many vague issues in the Bill that we (The DCR and DAS) currently do not track.
