Effect this measure will have on costs and revenues of state government.


This could significantly increase the cost of the WV DCR. There is not enough information yet to determine how many inmates may be affected by this change and at what long and short term cost would be associated with longer sentence structures. This Bill allows for Judges to have discretion to sentence inmates to a determinate sentences and increase current sentences This would impact overcrowding, medical, food service, etc. A cost of $35,452.00 per year , per inmate, was reported in the WV DCR Annual Report. An example cited in the bill would raise current Human Trafficking from a 3 year determinate sentence to no more than 15 years to a maximum (Current)15 years to no more than 40 years. Inmates at minimum would potentially be incarcerated 12 more years costing a potential $425,424.00 to discharge a sentence. Inmates would still be parole eligible and a 15 year determinate sentence would make the inmate parole eligible after 3 years 9 months. which is 36 months longer that current law permits. That is a minimum increase of $106,356.00 These figure are computed by our current report and do not consider standard inflationary costs. These funds would come from the General Budget as these are convicted felons serving in our prisons.

This could significantly increase the cost of the WV DCR. There is not enough information yet to determine how many inmates may be affected by this change. This Bill allows for Judges to have discretion to sentence inmates to a determinate sentences and increase current sentences. Inmates sentenced from passage would be the ones that are affected. This would impact overcrowding, medical, food service, etc. At some point, potentially down the road, more staff may need to be hired to supervise the increase in the overall population. A cost of $35,452.00 per year , per inmate, was reported in the WV DCR Annual Report. An example cited in the bill would raise current Human Trafficking from a 3 year determinate sentence to no more than 15 years to a maximum (Current)15 years to no more than 40 years.
