Effect this measure will have on costs and revenues of state government.
In regard to the Chapter 33 provisions of House Bill 2770, with only a few minor
variations, the provisions of House Bill 2770 are already in, and duplicative of,
existing state code sections regarding mental health parity that were previously passed
by the West Virginia Legislature in Senate Bill 291 (2020), and signed into law by the
Governor on March 25, 2020. As such, the OIC does not estimate any additional fiscal
impact from HB2770, since those proposed provisions are already in state code, the OIC
already promulgated the required rule in 2021, and the OIC has already issued annual
reporting for the Joint Committee on Government and Finance required by HB2770.

Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years.
Memorandum
Should House Bill 2770 pass as drafted, the identified articles of Chapter 33 would
have duplicative sections on mental health parity. As noted, the provisions of House
Bill 2770 are already in, and duplicative of, existing state code sections regarding
mental health parity that were enacted by the West Virginia Legislature in Senate Bill
291 (2020). As such, the OIC does not estimate any additional fiscal impact from
HB2770, since those proposed provisions are already in state code and the OIC is
already preparing the annual report for the Joint Committee on Government and Finance
required by HB2770. However, House Bill 2770 does appear to extend existing mental
health parity laws that are applicable to private health insurers to PEIA. As such,
PEIA should be consulted on any fiscal impact to PEIA.
