Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to require the Office of Health Facility Licensure and Certification to inspect office-based medication-assisted treatment programs at least every 24 months.
Currently, the Office of Health Facility Licensure and Certification (OHFLAC) performs unannounced complaint and verification inspections at Office-Based Medication-Assisted Treatment (OBMAT) programs, including review of patient records, to ensure the program complies with legislation and applicable rules. This bill adds to these inspections by requiring formal inspections of OBMAT programs at least once every 24 months, including review of patient records.
As of March 4, 2025, ninety-nine (99) OBMAT programs operate within the state of West Virginia, with an additional six (6) programs pending, for a total of 105 OBMAT programs. In order to comply with this additional inspection requirement, OHFLAC estimates that one (1) additional Health Facilities Surveyor will be needed to inspect all 105 OBMAT programs every 24 months. This will result in an average workload of 4-5 surveys per month.
As the bill does not provide any information relating to licensure fees, no additional revenues will be realized. As a result, this bill will only impact estimated costs.
As the OBMAT program is not a federally-funded program, costs associated with this program will be paid from the General Fund (fund 0437).

Explanation of above estimates (including long-range effect):
The estimated cost of this legislation to the Office of Inspector General's (OIG) Office of Health Facility Licensure and Certification (OHFLAC) is $103,085 in FY 2026 and $101,285 upon full implementation.
OHFLAC anticipates the need for one additional Health Facilities Surveyor 1 at one (1.0) FTE. The annual estimated costs of the additional FTE is $74,047 for personal services (State average salary $54,850 and fringe benefits $19,197) and $27,238 for current expenses (including rent, utilities, office supplies, training at $1,000 and travel at $26,238). For FY 2026, one-time equipment purchases will be needed upon hiring the new Surveyor and are estimated at $1,800. This totals to a FY 2026 estimated cost of $103,085. Upon full implementation, the estimated costs of the additional Surveyor continues at $74,047 for personal services (State average salary $54,850 and fringe benefits $19,197) and $27,238 for current expenses (rent, utilities, office supplies, training at $1,000, and travel at $26,238), totaling to $101,285.
This legislation will not impact estimated revenues as the bill does not affect licensure fees.
