Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to clarify the duties and responsibilities of mental health professionals in West Virginia. The bill provides for a physician, psychologist, licensed professional counselor, licensed independent social worker, advanced nurse practitioner, physician assistant, or law enforcement officer to make an application for involuntary hospitalization. Finally, the bill provides for the Department of Health Facilities to provide transportation for individuals who require involuntary hospitalization.
The bill creates the Mental Hygiene Fund within the Supreme Court of Appeals.
The Department of Human Services does not anticipate a fiscal impact related to this bill.

Explanation of above estimates (including long-range effect):
Memorandum
The department funds providers (mental health facilities) that may be tasked with holding clients for their hearing based on 27-5-1 (d) of this bill. Mental health facilities are providers for The Department of Human Services, and those facilities do not currently have authority to detain individuals who are potentially a danger to themselves or others prior to the hearing to determine whether there is sufficient evidence to commit these individuals to a mental health facility and without a court order. These facilities do not have trained staff, equipment, or facilities to safely hold individuals until such hearing.
Bill references Department of Health Facilities as being responsible for transport. Any fiscal impact to that Department is not reflected in this response.
Bill requires the Secretary of the Department of Health Facilities to develop an orientation program. Any costs associated with development of this program is not reflected in this response.
