This will impact cost / revenue of state government. The bill implies that students deficient in skills will not be allowed to move to fourth grade and be retained in grade 3. This could potentially increase the number of third grade classes needed in a school and require the hiring of additional teachers to ensure the class sizes meet state code (25 students).

Explanation of above estimates (including long-range effect):
Given the unknown of how many students may need to be retained as a result of this bill, we are unable to determine an exact cost . Professional staff may need to be hired to maintian the 25 to 1 student teacher ratio in third grade if students are retained. The current program of instruction for students in Grades K - 3 are the West Virginia College- and Career-Readiness Standards for reading and mathematics.
Memorandum
The introduced bill uses terminology that is unclear. The term "program of instruction" could be interpreted to mean standards identifying what is to be taught or instructional materials such as textbooks or other supports. If the latter, there would be significant cost to develop and/or purchase materials as well as conflict with local choice of instructional materials currently in code.
