Effect this measure will have on costs and revenues of state government.
As of the end of FY2018, the WVDCR had 966 inmates incarcerated for a Drug Offense as their most serous crime. Because of the way WV's drug laws are set up, its difficult to tell from the charge what specific drug was involved in the crime. In addition, its difficult to determine if marijuana was the SOLE drug involved.
If 5% of these offenders (48) are incarcerated for solely Marijuana related offenses, and they are released early as a result of this legislation, the State of WV could expect to save $941,712 per year of incarceration avoided (48 x $19,619 per year).
The WV State Budget Office calculated the cost of housing a state sentenced felon in a regional jail at $53.75 per day for fiscal years 2017-2019. The WVDCR uses this calculation to make payments to the regional jail special revenue fund for state sentenced prisoners. Because of the backlog of state sentenced prisoners in jails, most increases or decreases to the prison population are reflected in that backlog. Therefore, using the per Diem cost from the State Budget Office in fiscal note calculations results in a more accurate description of the impact of proposed legislation.
