Effect this measure will have on costs and revenues of state government.


House Bill 2079 would abolish the West Virginia Higher Education Policy Commission; transfer all powers and duties of the commission relating to the internal governance of institutions of higher education to the board of governors of the institutions; transfer all powers and duties of the commission to provide, secure or administer financial support for educational or research purposes including, but not limited to state or federal scholarships, grants, fellowships, and loans, to the Cabinet Secretary for the Department of Education and the Arts; provide for the transfer and disposition of assets, property of the commission; and authorize legislative and emergency rulemaking. This bill does not define “the powers and duties of the commission to provide, or administer financial support for educational or research purposes; consequently, it is not possible to determine the financial impact of this bill. Further, the costs associated with this bill would be incurred by the Cabinet Secretary of the Department of Education and the Arts. After July 1, 2016 the Higher Education Policy Commission costs would not incur any costs. If the needed definition was provided, the Cabinet Secretary could estimate her agency’s costs associated with the enactment of the bill. It may not be possible to transfer grants to another entity. If grants could not be transferred, federal awards totaling about $60 million would be lost. The Commission receives federal revenues for several programs including Gear Up. The value of these programs is based upon their operation at the system level. The Gear Up program has demonstrated its success in increasing low-income students attending colleges and universities. The Commission also receives federal revenues for research and to coordinate services to veterans.
