Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The intent of the existing state code is to compensate those counties that have a landfill to help offset the environmental impacts attributed to having a facility. These impacts are both direct and indirect. This proposed legislation shifts this money from the receiving facility to the county or region where the waste originates, therefore not compensating the receiving facility. This legislation would shift money from one solid waste authority to another, and possibly to out of state solid waste authorities. This change would have a substantial effect, both positive and negative, to various in state solid waste authorities. There would not be a fiscal impact to the Department of Environmental Protection's revenue because the agency does not currently get any portion of this $ .50 fee. This shift would effect various County revenues.

Explanation of above estimates (including long-range effect):


This change would impact County revenues but not money received by the State. In 2014 290,106 tons of solid waste was disposed of in West Virginia from out of state. This would amount to $145,053 in lost revenue for county solid waste authorities if the fee was paid to the originating out of state authority versus the in state disposal facility.
