Fiscal Note Summary

Effect this measure will have on costs and revenues of state government.

SB 59 would provide for an increase for magistrates by $2,375 in Tier 1 counties and by $2,000 in Tier 2 counties, effective July 1, 2006. Currently, magistrates in counties with 8,400 or more in population per magistrate (ยง50-1-3), or Tier 2 counties, are paid $40,000. Magistrates in Tier 1 counties, serving less than 8,400 in population per magistrate, earn $33,625. Current law establishes Tier levels, based upon 8,400 population per magistrate rather than 8,500 set forth in the Bill. Should the 8,400 population level be intended, the number of Tier 1 magistrates should be decreased 49 to 47 and the number of Tier 2 magistrates should be increased from 109 to 111. In this instance, the total annual cost would be $392,042.62. While the increase shown below would require an additional $392,924.06, it would not be needed until FY2007.
