Effect this measure will have on costs and revenues of state government.


This proposed legislation would change this substance from a Schedule V to a Schedule IV classified controlled substance. Scheduled V drug offenses do not carry a sentence to the WVDOC but Schedule IV drugs carry a 1 to 3 year indeterminate sentence. Therefore, for each offender sentenced to the WVDOC as a result of this legislation the State could expect a cost of $26,448 to $79,344 (average annual cost per inmate in FY 2013 x 3 years).
