Effect this measure will have on costs and revenues of state government.
Currently W. Va. Code 5B-2-12, states that $4,700,000 be transferred from the Tourism Promotion Fund to a Courtesy Patrol Fund to fund the Courtesy Patrol Program. The Courtesy Patrol Program provides assistance to stranded motorists along the state’s highway system. SB 598 amends 5B-2-12 to allow for an amount up-to $4,700,000 to be transferred to the Courtesy Patrol Fund rather than mandating that $4,700,000 be transferred. SB 598 appears to vest the Secretary of Commerce with the authority to evaluate the budgetary needs of the Courtesy Patrol Program to determine if the Courtesy Patrol Program is adequately funded. If the secretary determines that the Courtesy Patrol Program is adequate at a level less than $4,700,000, SB 598 requires those excess funds be directed to the Tourism Promotion Fund. This bill has no affect on the Division of Tourism's operational expenditures or revenues.
The Courtesy Patrol Program is contracted out by the Department of Highways (DOH). The Division of Tourism acts as a third party and merely reimburses DOH for their expenses with this contractor.
