Explanation of above estimates (including long-range effect):
Memorandum
The legislation establishes an exemption from the existing NH bed moratorium for beds that are "dedicated and solely operated as geriatric psychological beds" however it is not possible to calculate an estimate as there is no information available on what service utilization would be for this population, how many beds would be made available, or what specific services would be provided that are not already available through the existing Medicaid benefits for nursing home or behavioral health services. "Geriatric psychological" services are not defined, and it is therefore not possible to determine at this time whether these services would constitute an Institution of Mental Disease (IMD), prohibiting Medicaid from reimbursing for those services for individuals between the ages of 21 and 64.
The section of the legislation where the additional exemption language is added is the section containing the existing exemption related to acute care hospital conversion of existing acute care beds into skilled nursing beds, which the designation of a "skilled nursing facility operating in this state" does not appear to apply. Additionally, in other sections related to existing exemptions it specifically indicates that Medicaid would be a payer of the exempted beds, but there is not such a specification in the additional language therefore if the beds were established it is not known whether Medicaid would be a payer for those services.
