Effect this measure will have on costs and revenues of state government.


The title of this bills states that all juveniles over the age of 18 should be transferred to the Division of Corrections but the new language suggests that only those juveniles tried as adults and in the custody of the Division of Juvenile Services would be transferred to Corrections. Therefore, I am submitting this fiscal note based on both. If all juveniles over the age of 18 were transferred to Corrections it would be as follows: The Division of Juvenile Services reports that they currently have 49 residents over the age of 18. If all 49 of these offenders would be transferred to the custody of the Division of Corrections the annual cost would be $1,295,952 (49 x $26,448 average annual cost per inmate in FY 2013). This cost would decrease in further years as the number of transfers decreases to the number of residents that turn 18 during the year. However, this number is unknown at this time. If only those juveniles tried as adults who reach the age of 18 were transferred to Corrections it would be as follows: The Division of Juvenile Services reports that they currently have 5 residents over the age of 18 who have been sentenced as an adult. If all 5 of these offenders would be transferred to the custody of the Division of Corrections the annual cost would be $132,240 (5 x $26,448 average annual cost per inmate in FY 2013). This cost would decrease in further years as the number of transfers decreases to the number of residents that turn 18 during the year. However, this number is unknown at this time.

Memorandum


The title of the bill reflects that all juveniles over the age of 18 that are in the custody of the Division of Juvenile Services would be transferred to Corrections. However, the new language in the bill reflects that only those juveniles who were tried as adults and are currently in the custody of the Division of Juvenile Services would transfer to the Division of Corrections.
