Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to repeal or remove certain portions of education-related statutes that have expired or requires the continuation of certain programs that are not needed or not cost effective to continue. This includes the repeal of statutes related to: provisions of an expired pilot program for the delivery of leftover foods from schools and penal institutions; repeal of statutes related to establishing goals and priorities of OEPA; providing library media improvement grants; conducting studies of school equity, training, certification and licensing of professional educators, alternative certification programs and daily planning periods, where the studies have been completed and reports submitted; conducting meetings of county boards of education during 1961; deleting provisions for a check-off block on personal income tax return forms for adult literacy programs; deleting superseded or outdated provisions of the Public School Support Program; deleting provisions of the 1970’s Better Schools Buildings program; deleting requirements related to the filming of exemplary teaching techniques of teachers at every school; and deleting the requirement of semiannual reporting of the effectiveness of raising the compulsory school attendance age to 17. The bill also revises statutes to delete the requirement for a biannual study of the effectiveness of character education programs at every school by an independent contractor, and decreases the number of copies of report that need to be submitted to the legislative librarian from 20 to one.

Explanation of above estimates (including long-range effect):


It is estimated that the repeal of the outdated statutes will enable the WVDE or the various county boards of education to avoid costs for requirements that are no longer valid or cost effective. These include: a cost savings to the State of $50,000 per year by eliminating the requirement to provide funding for a library media improvement grant program; the cost avoidance of at least $100,000 per year for the county boards and the RESAs by eliminating the need to film exemplary teaching techniques at every school, reimburse the travel costs of teachers from each school to select the best film for each subject area, pay a bonus to all the teachers whose films are selected for statewide display; and the estimated cost avoidance of $80,000 every other year (average of $40,000 per year) to the State for eliminating the requirement that the WVDE contract with an independent vendor to determine the effectiveness of character education programs delivered by the various county boards.
