Effect this measure will have on costs and revenues of state government.


The Division of Juvenile Services reports that there has not been a juvenile with a life sentence committed to their custody in the past three years. Therefore, the WVDOC estimates that the passage of this legislation would not have a financial impact on the State of West Virginia. However, if a juvenile, who would normally be sentenced to Life Without Mercy, would instead be sentenced to Life With Mercy in the future, the inmate would have the opportunity for parole after 15 years. If the inmate would receive parole, then the State could expect to save $26,448 per year that they would have been incarcerated (based on FY 2013 average annual cost per inmate). The exact amount of this savings is very difficult to estimate and any savings gained as the result of this legislation would not be realized for at least 15 years.
