Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The purpose of this legislation is to regulate tanning facilities. The proposed legislation requires the Department of Health and Human Resources (Department), through the Bureau for Public Health to propose rules for legislative approval in accordance with the provision of article three, chapter twenty-nine-a to regulate tanning facilities. The rules shall provide at a minimum: general physical requirements for facilities and equipment, including requirements for ventilation and lighting; record keeping requirements; requirements for the posting of warning signs about the dangers inherent in the use of a tanning device; proper sanitation of a tanning facility and a tanning device including a requirement that the tanning device be cleaned immediately prior to each use; proper maintenance and operation of a tanning device including accuracy and placement of a timing device; the use of protective eyewear provided by the tanning facility and the proper storage and cleanliness of the eyewear; require that patrons are limited to using the tanning device to the exposure limits set by the manufacturer of the tanning device; and establish the permit application process and fee requirements. The Department estimates that based on the proposed language, any cost associated with the development of the rules stated above, would be minimal and that the Department could fund with existing resources. The Department estimates that the proposed legislation could result in increased costs to the local boards of health. These increased costs would be a result of their responsibility to enforce registration, issue permits and perform inspections.
