The WVDOC, as of June 30, 2011, had 38 offenders incarcerated for DUI With Death. We cannot predict with certainty how many additional offenders may be sentenced under the “life” penalty described in this legislation, however, for each offender thus sentenced the state can expect a cost of $23,674 per year they are incarcerated (average cost per inmate in FY 2011). Offenders serving “life” sentences (it is unclear in the draft legislation if this is Life with Mercy or Life W/O Mercy) typically serve a minimum of 15 years prior to parole eligibility. Such an offender would cost the State at least $355,110 over those 15 years. If that offender served 30 years the cost would be $710,220 (based on FY2011 dollars).
