Effect this measure will have on costs and revenues of state government.


This bill creates a "Keep Jobs in West Virginia Act". It requires all work performed on state contracts be performed in the United States. The bill also allows the state to seek damages and void contracts when work is done outside the country. There will be no fiscal impact to Department of Administration as long as the Purchasing Division can make companies self-certify that all work will be performed in the United States.

Explanation of above estimates (including long-range effect):


The fiscal impact to the state as a whole with the passage of this bill can not be estimated. A state entity may be able to save money by utilizing a company located outside the United States. However, using a workforce within the United States will provide jobs to US Citizens and could improve the economy. Those factors should be considered when looking at the fiscal impact.



Memorandum


The Purchasing Division already makes vendors self-certify in other areas such as resident vendor status, veteran status, that they owe no debt to the state and when they are a small women and minority business.
