Effect this measure will have on costs and revenues of state government.
The roadway in question is similar to many other subdivisions in the State in that they were not constructed to meet State standards and specifications. The estimated cost to repair the slide alone on this road is $355,013.
Note, however, that acceptance of the roadway does not indicate that work will be accomplished in the near future. The roadway in question will need to compete with all roads for funding.

Explanation of above estimates (including long-range effect):
The above cost is from an estimate prepared in 2011 at the request of the county commission. The estimate does not include the cost of any plan development, right of way acquisition, possible relocation or utility costs.
The estimate includes contractor mobilization, traffic control, piling wall, riprap, asphalt paving and guardrail.
The cost provided is based on if the road was added to the State Highway System and was then prioritized high on the list of proposed projects to qualify for our limited funding.
Memorandum
The legislation is contrary to WV Code 17-4-1 whereby "The authority and control over the state roads shall be vested in the commissioner of highways." The Division of Highways has a policy currently in place prohibiting the acceptance of new roads due to the lack of sufficient funding to maintain the current 36,000 miles already in the highway system.
The legislation is similar to 17-2C that created the Orphan Road and Bridge Acquisition Program. The Legislature allowed this program to sunset in December 2001 due to the high costs incurred.
Passage of the legislation does not guarantee the local subdivision any improvements to the roadway. The road will be prioritized in relation to all other local roads.
Acceptance into the system will also require the citizens to obtain driveway permits and to meet other requirements (culvert size) etc of a roadway in the system.
Enactment of this bill will set a precedence whereby all citizens living on private roads will be seeking legislative assistance.
The DOH does not recommend passage of this bill.
