Memorandum


The stated purpose of this bill is to authorize counties, county boards of education and municipalities to receive funds from levies to support public libraries. The bill also establishes the amounts to be collected for the different classes of property. The bill permits libraries to seek funding from municipal and county authorities. The bill also states the legislative intent. The proposed bill amends the current statute in its entirety. Currently, W. Va. Code §10-1-2 provides funding for public libraries through the “(1) appropriation from general funds of the governing authority of a sum sufficient for the purpose, or (2) by the imposition of an excess levy for library purposes, in accordance with the provision of section sixteen, article eight, chapter eleven of this code.” W. Va. Code §11-8-16 defines the process for an election to be held for an excess levy, and this reference is not included the proposed legislation.
