"The purpose of this bill is to remove references to ""mentally retarded"" and ""mental retardation"" in healthcare-related legislation and replace those references with ""intellectually disabled,"" ""individual with an intellectual disability"" and ""intellectual disability. " As written the proposed legislation will have minimal impact on the Department of Health and Human Resources. Please see memorandum section below for additional comments and concerns.

Memorandum


This legislation would require the redesign and redistribution of policy information, reference materials, forms, and brochures. The changes to these materials would cause a fiscal impact, however the impact would be minimal and absorbed in the budget for the fiscal year that the changes become effective. Technical flaw: WV code §27-2A-1(b) has a remaining reference to "mental retardation" in the first sentence. "Any new mental health centers and comprehensive mental retardation facilities…"
