Effect this measure will have on costs and revenues of state government.


If the provisions of this bill were to become law it would have a positive fiscal impact on the WV Division of Corrections. As of June 30, 2009, the WVDOC had 69 offenders who’s most serious crime was 2nd Degree Petit Larceny, or 3rd Offense Shoplifting. Those charged with shoplifting, must spend at least one year incarcerated before being eligible for parole. Petit Larceny offenders must spend 3 months before being parole eligible and often do not ever make it into the physical custody of the WVDOC. However, the 69 offenders previously mentioned may have cost the State of West Virginia up to $1,768,919 to house for just one year (based on $25,651 per year average cost in FY09). Additionally, there are added operational benefits associated with reducing the overall inmate population and the jail backlog situation.
