The purpose of this bill is to require the Secretary of the Department of Health and Human Resources to make recommendations to the Joint Committee on Government and Finance relating to seeking Medicaid waiver for traumatic brain injury patients.
As written, the proposed legislation will have no impact on the Department of Health and Human Resources.

Explanation of above estimates (including long-range effect):
Memorandum
In the case of E.H. v. Matin, Circuit Court of Kanawha County, case 81-MISC-585, the Department was required by order of the court to complete and file a Medicaid waiver application to provide home and community based services for persons with traumatic brain injuries. To now complete a study for the Legislature's review could place the Department in a posisiton of being unable to comply with the order of the court.
