Effect this measure will have on costs and revenues of state government.


To this date the WVDOC has had no inmates sentenced to our custody under 61-8B-10, therefore it is difficult to predict the fiscal impact of this change. However, because the minimum length of time a person can remain incarcerated under this law is 1 year and the proposed legislation would increase the minimum to 10, then for every inmate sentenced under the new law the State can expect an additional cost of $230,859 (based on FY09 average cost: $25,651 x 9 = $230,859).
