| The proposed legislation would transfer to the Cabinet Secretary plenary authority for approving water permits, where such permits in the context of coal mining and oil and gas operations currently must be approved by both the director of the Division of Water and Waste Management and the director of the Divison of Mining and Reclamation (the latter being the Secretary's designated authority for mining permits), or by both the director of DWWM and the chief of the Office of Oil and Gas (the latter being the statutory authority for oil and gas permits). The legislation would neither change the number of permits processed by DEP nor increase or decrease any permit fees. |
