Effect this measure will have on costs and revenues of state government.


The proposed legislation would increase the penalty for misappropriation of an elderly person’s funds from 2 to 10 years to 5 to 15 years. Currently, the WVDOC only has one such offender in custody so a fiscal impact in this case is hard to determine. However, because of West Virginia’s “day-for-day” good time law the effective maximum sentence for this crime has increased by 2.5 years (Being 5 years for the 2-10 and 7.5 years for the 5-15). Therefore, future offenders sentenced to WVDOC custody under this code could spend 2.5 years more than current offenders, costing the State of West Virginia up to $58,160 more per offender (the average cost per inmate in FY 2008 was $23,264 x 2.5 = $58,160).
