Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The purpose of the bill is to establish a statewide reporting system for hospitals to report their infection rates and to improve the incidence of infections in West Virginia hospitals. The proposed legislation directs the Health Care Authority to create an Infection Control Advisory Panel consisting of specific members to provide guidance and oversight in implementing this legislation. The proposed legislation establishes panel responsibilities, limitations on use of information and provides that all hospitals shall report information on healthcare-associated infections in accordance with standards prescribed by CDC National Healthcare Safety Network (NHSN), as adopted by the WV Healthcare Authority. The proposed legislation allows for a fine in the amount of $5,000 to be assessed for each failure of a hospital to report information on healthcare-associated infections in the manner and time frame required. The Health Care Authority is unable to provide an estimate of the possible number of instances in which hospitals fail to report. Additionally, it is estimated that any funding collected under the authority to fine hospitals for failure to report, would be deposited into the state general revenue fund. The Health Care Authority estimates that the proposed legislation would have a minimal fiscal impact upon the current operating budget and could be handled without a need for an increase in current level appropriation.
