Fiscal Note Summary

Effect this measure will have on costs and revenues of state government.

One hearing in magistrate court can, and frequently does, involve the disposition of a number of criminal matters that are separate and distinct. Often, multiple criminal charges are listed on a single complaint, with each offense being given its own individual case number. Whereas the different criminal charges may have arisen out of the same general series of events, each charge is separate and distinct. If a defendant pleads guilty to a number of the charged offenses, each guilty plea is, and is treated as, a separate criminal case. In such situations, if the court was constrained to impose only one court cost per hearing, even though a number of separate cases were being disposed of during said hearing, the loss of revenue would be staggering. The revenue obtained via the imposition of court costs provides financial support for each of the following entities: -Magistrate Court Fund -Court Security Fund -Regional Jail Authority -Crime Victim Compensation Fund -Law Enforcement Compensation Fund -Regional Jail Per Diem Fee -Community Correction Fund -Courthouse Improvement Fund -Regional Jail Operation Fund If the revenue that supports these funds is either cut off or dramatically decreased, other revenue sources will have to be located for the support of these funds, otherwise, these funds may either cease to be effective or cease to exist.
