Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The new exemption eliminates Public Service Commission (PSC) from oversight authority on wrecker services. PSC must maintain the ability to enforce 17C of the Code or the following two major losses will occur: 23 USC 127(a) requires the DOH enforce minimum and maximum weight limits on the Interstate System not to exceed the allowable weight under the bridge formula. Failure to enforce the weight restrictions is a withholding of the monies allocated for the National Highway System. In FY 2008, this would be a loss of $53,500,000. 23 USC 141(a)&(b) requires the DOH to enformce maximum weight and size limits on vehicles on the Federal Aid System. Failure to enforce the weight and size limits on this system is 10% of the monies allocated for the National Highway System. In FY 2008, this would be a loss of $17,830,000.
