The fund provides for an exemption to new residents on the privilege tax. The DOH deferes to DMV for the fiscal impact to the Road Fund. Please see the memorandum for other concerns by the DOH.

Memorandum


11-15-3b(f)(1) indicates that the Commissioner of Highways shall propose emergency rules. Since the money is collected by the DMV, it is suggested that this be changed to the Commissioner of Motor Vehicles. 11-15-3(b)(h) and 17A-3-4(b)(7) state that the monies collected on the registration of a vehicle shall be expended by the Commissioner of Highways for "matching federal funds." The budget bill always directs that the DOH is to first pay our debts and then to match federal monies. This will create a funding problem for the DOH if all monies are dedicated for matching funds. The DOH will not be able to expend any monies on county roads which is the majority of the State's highways. It is suggested that the wording be revised to state that the monies will be expended by the Commissioner of Highways for "...design, maintenance and construction of roads in the state highway system."
