Effect this measure will have on costs and revenues of state government.


This legislation transfers $4.3 million from railroad diesel burn currently dedicated to the State Road Fund to a newly created fund designated as the "Special Railroad and Intermodal Enhancement Fund." The State Road Fund is used by the DOH for highway maintenance, design and construction. The newly created fund will be used by the Public Port Authority for the planning, development, construction and operation of an intermodal facility at Prichard WV. The fund will expire on 6-30-2016.

Explanation of above estimates (including long-range effect):


The legislation will have a decrease to the Division of Highways and an increase to the Public Port Authority: 1. Decrease the State Road Fund by $4.3 Million/Yr used by the Division of Highways. 2. Create the Special Railroad and Intermodal Enhancement Fund used by the Public Port Authority, thus providing them with new revenue in the amount of $4.3 Million/Yr.



Memorandum


Legislative attornies may want to review this legislation to assure that there is no contradiction to Article VI, Section 52 of the Constitution of West Virginia: "Revenue from gasoline and other motor fuel excise and license taxation, motor vehicle registration and license taxes, AND ALL OTHER REVENUE derived from motor vehicles or MOTOR FUELS SHALL...be appropriated and used SOLELY for the construction, reconstruction, repair and maintenance of public highways."
