Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The Division of Corrections has no way to estimate how many years judges will sentence DUI with Death offenders for under this proposed legislation. Assuming however, that the average sentence would be 10 years the Division of Corrections does not anticipate a significant fiscal impact as the West Virginia Parole Board statistics reveal that only a very few of these offenders are granted parole before their third year of incarceration. However, for each additional year each offender spends in DOC custody, the state can expect a fiscal impact of $24,410.
