The purpose of this bill is to provide a mechanism whereby unused, unexpired non-narcotic drugs previously owned by a deceased nursing home patient or resident may be donated to free health care clinics in the state, provided that the family of the deceased patient or resident has given consent to the donation. This bill requires the director of PEIA to establish a system to collect unused, unexpired non-narcotic drugs from nursing homes after a resident has died. Passage of this legislation would require a new program to oversee such things as obtaining consent for the unused drugs, inspecting the integrity of the drugs, review the class and best use of the remaining drugs, inventory and dispensing these drugs to free health care clinics in an equitable manner unless there is a critical need within one of the free health care clinics. It is not clear in the bill why the director of PEIA would be held responsible for this program as it does not appear to be designed to impact PEIA members, but rather, is to assist persons in free health care clinics that most likely do not have health care insurance. Also, PEIA does not normally interact with nursing homes or free health care clinics except as a payer of services. It is the recommendation of PEIA that this program could be more appropriately placed under an Agency based upon the persons most likely to be served. Should PEIA be required to establish such a program the primary costs would be administrative. The hiring of a pharmacist, along with benefits, would be imperative to manage the program. Additional costs would be office materials and equipment along with the collection and storage of the unused drugs until dispensing to the free health care clinics. Anticipated costs are as follow: FY-2008 $136,500 FY-2009 $141,825 FY-2019 $149.915 Total Cost $428,240
