Actuarial Note Regarding Pension Legislation The Bill contains changes to the disability provisions as developed by the joint disability sub-committee of the CPRB and the State Police. The Bill contains several definitions to clarify certain disability provisions. It provides a definition of partially disabled to allow a member to perform other than law enforcement duties. It specifies that law enforcement duties do not include certain elected positions, such as sheriff, as long as only administrative duties are performed. The Bill further limits compensation to health care providers treating disabled members to be limited to the current rate schedule in use by Workers’ Compensation Commission.

Explanation of above estimates (including long-range effect):


The provisions of the Bill are intended to clarify benefit provisions already in effect for the Plan. They are not intended to expand nor reduce benefits provided to members. Although some administrative cost savings might result due to the clarifications, the relatively small number of active members that might be impacted by the changes make any cost savings minimal. The intent of the Bill is to clarify the benefit entitlement provisions.



Memorandum


The Bill provides certain medical payments to be limited to the current rate schedule in use by Workers’ Compensation Commission. The Worker’s Compensation Commission is set to be phased out of existence by December 31, 2005. The Bill should be modified to reflect the changes in West Virginia Workers Compensation.
