Effect this measure will have on costs and revenues of state government.


The fiscal impact of putting the State Americans with Disabilities Act Coordinator into statue will be cost neutral to the state. The bill states the coordinator may be a current employee of the Department of Administration or other agency employee. The Department of Administration currently has an individual employed in that capacity.

Explanation of above estimates (including long-range effect):


The person currently serving in this position is an employee of the Division of Personnel. This bill simply codifies a current position because of the federal law which mandates states have a person in position. There would be no additional cost to the State since the position is already established. The individual in the position currently earns approximately $58,203 with benefits. It is unknown whether any future administrations would want to hire additional personnel but no additional employees will be hired by this Administration. By having this position in code provides West Virginia with a risk reduction and will help the state to avoid potential federal penalties. The statue gives the Cabinet Secretary of the Department of Administration the ability to assess, charge and collect fees from each state spending unit or private entity for the direct costs and expenses incurred by the coordinator. There will be no negative fiscal impact to the state because funding for this position will come out of each agencies current budget allocations. There will be a positive fiscal impact because having a person on staff who is knowledgeable about the ADA will avoid the necessity of hiring outside contractors to survey state buildings. Another added benefit is the ADA Coordinator reviews all blueprints and floor plans for new office building prior to construction or rental to ensure they are constructed in accordance with the ADA and thus avoiding additional expense later in the process. The total amount collected from all agencies shall not exceed $100,000 each year for the first three years. Moneys from the Americans with Disabilities Act Coordinator Fund will be used to pay the salary, travel expenses, etc. for the coordinator’s office.
