Effect this measure will have on costs and revenues of state government.


The adoption of this bill, which would permit any employee of the state to take an extended leave of absence without pay for up to one year with the approval of his or her immediate supervisor, is estimated to have no fiscal impact for agencies with classified employees, as this benefit is already provided. WV Code § 29-6-10 (12) and the Division of Personnel Administrative Rule (14.8.(c)) now mandate that employees meeting certain conditions be granted a medical leave of absence without pay for up to six months, with an additional six months of personal leave of absence for medical reasons generally granted, if necessary, as a standard agency practice. The Division of Personnel Administrative Rule (14.8.(a)) allows personal leaves of absence without pay, normally not to exceed one year, at the discretion of the employer based on the agency’s personnel needs. In both cases, medical and personal leave of absence without pay, the employee is returned to duty to either his or her former position, or one of comparable pay and duties, without loss of rights , unless the position is no longer available due to a reduction-in-force (14.8.(d)). For agencies with classified-exempt employees, we estimate no fiscal impact as most of these agencies ‘ leave practices conform to the provisions of our Administrative Rule. For institutions of higher education, we assume no fiscal impact. It is our understanding that provisions for leaves of absence without pay at least as generous as those proposed in this legislation are now available for both faculty and staff.

This bill is estimated to have no fiscal impact for agencies with classified or classified-exempt employees nor for institutions of higher education, as similar or more generous leave of absence benefits are already provided.
