Effect this measure will have on costs and revenues of state government.


House Bill (Reference No. 2003R386), would include parole officer and probation officer to the definition of law-enforcement officers to WV Code 18B-10-7. As stated below: 18B-10-7. Tuition and fee waivers for children and spouses of officers and firefighters killed in the line of duty. Each state institution of higher education shall permit any person to attend its undergraduate courses and classes if classroom space is available without charging such person any tuition or any fees, including those provided in sections two and three of this article, if such person is the child or spouse of a law-enforcement officer as defined in section one, article twenty-nine, chapter thirty of this code, a correctional officer at a state penal institution, a conservation officer, or a registered firefighter, and such officer or firefighter was killed in the line of duty while employed by the state or any political subdivision thereof, or such firefighter was a member of a volunteer fire department serving a political subdivision of this state. According to the Department of Corrections, as of February 2002, to the best of their knowledge, no parole or probation officers have been killed in the line of duty during the past several years; therefore the immediate cost to the State of West Virginia would be zero. If a parole officer were killed in the line of duty and his/her spouse or children would take advantage of this opportunity, the estimated cost could be projected as follows: The average cost of regular tuition and fees for an in-state full-time undergraduate student for Academic Year 2002-2003 is $2,473 per student.

It is not possible to project the number of children or spouses of parole officers or probation officers killed in the line of duty who might take advantage of this legislation. The current cost of tuition and fee revenue that would be forgiven is $2,473 per student.
