The House of Delegates met at 11:00 a.m., and was called to order by the Honorable Richard Thompson, Speaker.
Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
The Clerk proceeded to read the Journal of Thursday, January 20, 2011, being the first order of business, when the further reading thereof was dispensed with and the same approved.
Committee Reports

The Speaker announced that, on Wednesday, January 19, 2011, the House received a committee report with an erroneous second reference.
H. B. 2498, Relating to the practice of dentistry, originally had a second reference to the Committee on the Judiciary when it was introduced.
H. B. 2498 is now in the Committee on the Judiciary, under the original referral.

Messages from the Senate

A message from the Senate, by
The Clerk of the Senate, announced the adoption by the Senate and requested the concurrence of the House of Delegates in the adoption of the following concurrent resolution, which was read by its title as follows:
S. C. R. 7 - "Relating to the payment of bills for supplies, services and printing and authorized contingent and other expenses of the eightieth Legislature."
Resolved by the Legislature of West Virginia:
That for the regular and any extraordinary session of the eightieth Legislature, the Auditor of West Virginia, in advance of the appropriation for such purposes, is hereby authorized, upon proper requisition of the Clerk of the Senate and the Clerk of the House of Delegates, to pay bills for supplies and for services furnished to the Legislature preparatory to the beginning of, during and following the adjournment of sessions, including contingent expenses of the respective houses; the per diem of officers, other than the President of the Senate and the Speaker of the House of Delegates, and employees of the Senate and of the House of Delegates; travel expenses of members as authorized by law; bills for legislative printing as the accounts for same become due; and any other authorized contingent and other expenses of the Legislature or the respective houses.
At the respective requests of Delegate Boggs, and by unanimous consent, reference of the resolution (S. C. R. 7) to a committee was dispensed with, and it was taken up for immediate consideration and adopted.

Resolutions Introduced

Delegate Barker offered the following resolution, which was read by its title and referred to the Committee on Rules:
H. C. R. 20 - "Requesting the Division of Highways to name the bridge in Foster on West Virginia Route 3, bridge number 03-03-11.12, as 'The Daniel M. Gunnoe Memorial Bridge'."
Whereas, Daniel M. Gunnoe was born in 1880 in Foster, West Virginia; and
Whereas, Daniel M. Gunnoe was married to the late Carrie Dolin Gunnoe and had four children, Calbert Gunnoe, Ivory Gunnoe Thompson, Margie Gunnoe Ashby, and Myrtle Gunnoe Miller; and
Whereas, Daniel M. Gunnoe lived his entire life in the Foster community, serving as the postmaster from April 1918 until April 1946, as well as owning and operating "Gunnoe's Grocery"; and
Whereas, Daniel M. Gunnoe was the first person in Foster to own an automobile and would take people to the doctor and hospital, and was also the first person in Foster to have a telephone; and
Whereas, Daniel M. Gunnoe passed on in 1959; therefore, be it
Resolved by the West Virginia Legislature:
That the Legislature hereby requests the Division of Highways to name the bridge in Foster on West Virginia Route 3, bridge number 03-03-11.12, as "The Daniel M. Gunnoe Memorial Bridge"; and, be it
Further Resolved, That the Division of Highways is hereby requested to have made and be placed signs identifying the bridge as "The Daniel M. Gunnoe Memorial Bridge"; and, be it

H. C. R. 21 - "Declaring that February 6 be proclaimed 'Ronald Reagan Day' beginning in 2011."
Whereas, President Ronald Wilson Reagan, a man of humble background, worked throughout his life serving freedom and advancing the public good, having been employed as an entertainer, union leader, corporate spokesman, Governor of California and President of the United States; and
Whereas, Ronald Reagan served with honor and distinction for two terms as the fortieth President of the United States of America; the second of which he earned the confidence of three- fifths of the electorate and was victorious in forty-nine of the fifty states in the general election, a record unsurpassed in the history of American presidential elections; and
Whereas, In 1981, when Ronald Reagan was inaugurated President, he inherited a disillusioned nation shackled by rampant inflation and high unemployment; and
Whereas, During Mr. Reagan's presidency he worked in a bipartisan manner to enact his bold agenda of restoring accountability and common sense to government which led to an unprecedented economic expansion and opportunity for millions of Americans; and
Whereas, Mr. Reagan's commitment to an active social policy agenda for the nation's children helped lower crime and drug use in our neighborhoods; and
Whereas, President Reagan's commitment to our Armed Forces contributed to the restoration of pride in America, her values and those cherished by the free world, and prepared America's Armed Forces to meet 21st Century challenges; and
Whereas, President Reagan's vision of "peace through strength" led to the end of the Cold War and the ultimate demise of the Soviet Union, guaranteeing basic human rights for millions of people; and
Whereas, February 6, 2011, will be the 100th anniversary of Ronald Reagan's birth and the seventh since his passing; therefore, be it
Resolved by the Legislature of West Virginia:
That February 6 be proclaimed "Ronald Reagan Day" beginning in 2011.
Delegates Hamilton, Anderson, Armstead, Ashley, Azinger, Border, Canterbury, Carmichael, Ellem, Evans, Overington, M. Poling, Romine and Walters offered the following resolution, which was read by its title and referred to the Committee on Rules:
H. C. R. 22 - "Requesting that bridge number 49-33-6.09 on Route 33 at mile marker 6.09 in Upshur County, West Virginia be named the 'Delegate Dale F. Riggs Memorial Bridge'."
Whereas, Dale F. Riggs was born on December 28, 1929, at St. Marys, West Virginia, a son of the late William Porter and Rhoda Ann Flint Riggs; and
Whereas, On June 23, 1953, Dale married the former Carolyn Rosalie Lantz who preceded him in death and together they had five children; and
Whereas, Dale was the owner and operator of Galloway Company, Incorporated and Ann Lorentz Coal Company and was involved with various oil and gas companies. He was also a charter member of the Progressive Bank NA and had served as chairman of the board and was a director for the bank; and
Whereas, Dale was an avid West Virginia University Mountaineers fan, having started the first West Virginia University Mountaineer Athletic Club in Upshur County; and
Whereas, In 1988, Dale was elected to the House of Delegates where he served the citizens of Upshur County with honor and distinction for six consecutive terms. Dale deeply cared for the Legislature and the legislative process, and he diligently worked with other members regardless of political affiliation to solve the problems confronting our state; and
Whereas, In addition to his public service, Dale dedicated much time to various causes and was a member of numerous organizations, including the Buckhannon Moose Lodge #598, Elks BPOE 1736, the Buckhannon Chamber of Commerce, and the Region 7 Aging Service Board of Directors. He was also a member of the Upshur County Humane Society and donated the land and building for its animal shelter; and
Whereas, Dale's service and commitment to his community were recognized with numerous awards including being twice named the Upshur County Citizen of the Year by the Buckhannon Chamber of Commerce and Republican of the Year by the Upshur County Republican Executive Committee. He was also presented the Strawberry Spirit Award by the West Virginia Strawberry Association; and
Whereas, Dale departed his earthly life on July 30, 2007, at the age of seventy-seven; therefore, be it
Resolved by the Legislature of West Virginia:

That the Division of Highways is hereby requested to name bridge number 49-33-6.09 on Route 33 at mile marker 6.09 in Upshur County, West Virginia the "Delegate Dale F. Riggs Memorial Bridge"; and, be it
Further Resolved, That the Commissioner of the Division of Highways is hereby requested to erect signs at both ends of the bridge containing bold and prominent letters proclaiming the bridge the "Delegate Dale F. Riggs Memorial Bridge"; and, be it
Further Resolved, That the Clerk of the House of Delegates forward a certified copy of this resolution to the Commissioner of the Division of Highways and to his children, Mark Riggs, Gregory Dale Riggs, Susan Riggs Arey, Jane Riggs and Robyn Riggs Simons.
Delegates Caputo, Longstreth and Manchin offered the following resolution, which was read by its title and referred to the Committee on Rules:
H. C. R. 23 - "Requesting the Division of Highways to name bridge number 25-9-6.67, currently known as the 'Whetstone Bridge' on Whetstone Road near Mannington, Marion County, West Virginia the 'Howard "Junkie" Masters Bridge'."
Whereas, Howard "Junkie" Masters was born on September 21, 1925, the son of Daniel and Elizabeth Masters; and
Whereas, Howard "Junkie" Masters was raised in Mannington, Marion County and joined the Navy on December 7, 1943; and
Whereas, Howard "Junkie" Masters served as a gunner on liberty, tanker and victory ships escorting Merchant Marine convoys across the Atlantic and Pacific Oceans during WWII; and
Whereas, Seaman 1st Class Howard "Junkie" Masters was honorably discharged from the Navy on March 16, 1946, having served his country with valor and distinction; and
Whereas, Howard "Junkie" Masters returned to the Mannington area after the war, where he and his beloved wife of 57 years, Eldora "Dora" Masters, raised two daughters, Linda and Darla, and two sons, Stanley and Harlan; and
Whereas, Howard "Junkie" Masters worked at the Mannington junk yard for twenty years cutting scrap metal with a torch, where he acquired his colorful nickname, "Junkie"; and
Whereas, He then worked as a welder for Pennzoil for twenty-seven years until his retirement; and
Whereas, It is only fitting and proper that we acknowledge Howard "Junkie" Masters for his devoted service to his country and for a long life well-lived; and
Whereas, Howard came of age during the Great Depression, endured numerous hardships on behalf of his country in World War II, and then returned home to help build a modern post-war America, where his life personifies the grit, determination and selfless contribution that led Tom Brokaw to name his generation "America's Greatest Generation"; therefore, be it
Resolved by the Legislature of West Virginia:
That the Legislature hereby requests the Division of Highways to name bridge number 25-9- 6.67, currently known as the "Whetstone Bridge" on Whetstone Road near Mannington, Marion County, West Virginia the "Howard 'Junkie' Masters Bridge"; and, be it
Further Resolved, That the Division of Highways is hereby requested to have made and be placed, signs identifying the bridge as the "Howard 'Junkie' Masters Bridge"; and, be it
Further Resolved, That the Clerk of the House of Delegates forward a certified copy of this resolution to the Secretary of Transportation, Howard "Junkie" Masters and his family members.
Delegates Andes and Savilla offered the following resolution, which was read by its title and referred to the Committee on Rules:
H. C. R. 24 - "Requesting the Division of Highways to name the bridge located on the new Route 35, crossing Route 34 at Poplar Fork, Putnam County, specifically bridge number 40-35-2.40, the 'PFC Roger Lee Byus Memorial Bridge, Killed in Action, Vietnam 1969'."
Whereas, Roger Lee Byus was born on March 23, 1949, the son of Mervin C. Byus, Jr. and Alma Ruth Ball Byus in Winfield, Putnam County, West Virginia and raised and educated in Putnam County. He attended Black Lick School, a one-room elementary school near his home, Hurricane Middle School and Hurricane High School, where he played football. He enjoyed hunting, fishing and riding motorcycles and any activity related to snow. He was employed by C. H. Heist Corporation. He married Judy Elaine Dillon on September 19, 1966. Eight days later she was killed in an automobile accident; and
Whereas, On March 20, 1969, Roger Lee Byus was inducted into the United States Army along with his two best friends, William Gillespie and Keith Grant and were sent to Fort Knox, Kentucky where he completed his basic and AIT training. He was then sent to Vietnam, arriving there on October 13, 1969, where he became a member of the elite 11th Armored Calvary, Blackhorse Regiment, Second Squadron, E Troop as a gunner. On November 24, 1969, while on a volunteer mission in Phuoc Long, South Vietnam, E Troop encountered enemy forces and called for mortar support. The coordinates were incorrectly sent and E Troop suffered a direct hit injuring PFC Roger Lee Byus who was dead upon arrival at a base hospital; and
Whereas, PFC Roger Lee Byus made the ultimate sacrifice for his country, during the conflict in Vietnam, earning the Purple Heart, Bronze Star and other medals posthumously; and
Whereas, The nature of the sacrifice of this brave and courageous son of Putnam County requires us to honor his memory, by ensuring that future generations are aware of his bravery and sacrifice in the cause of freedom; therefore, be it
Resolved by the Legislature of West Virginia:
That the Legislature hereby requests the Commissioner of the Division of Highways to name bridge number 40-35-2.40, located on the new Route 35, crossing Route 34 at Poplar Fork, Putnam County the "PFC Roger Lee Byus, Memorial Bridge Killed in Action, Vietnam, 1969"; and, be it
Further Resolved, That the Commissioner of the Division of Highways is hereby requested to cause to be fabricated signs to be erected at each entry of said bridge, containing bold and prominent letters proclaiming the bridge to be the "PFC Roger Lee Byus Memorial Bridge Killed in Action, Vietnam, 1969"; and, be it
Further Resolved, That the Clerk of the House of Delegates forward a certified copy of this resolution to the Secretary of Transportation, the Commissioner of the Division of Highways, and the surviving family of PFC Roger Lee Byus.
