The House of Delegates met at 11:00 a.m., and was called to order by the Speaker.
Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
The Clerk proceeded to read the Journal of Wednesday, January 11, 2005, being the first order of business, when the further reading thereof was dispensed with and the same approved.

Chairman Amores, from the Committee on the Judiciary, submitted the following report, which was received:
Your Committee on the Judiciary has had under consideration:
H. B. 2136, Requiring the clerk of the county commission to execute, record and post a disclaimer relating to certain unlawful covenants,
And reports the same back, by unanimous vote of the Committee, with the recommendation that it do pass.
Having been reported from committee with no dissenting vote, and in accordance with the provisions of House Rule 70a, the foregoing bill (H. B. 2136) will be placed on the Consent Calendar.
Messages from the Executive

Mr. Speaker, Mr. Kiss, presented the eighty-fourth annual report of the West Virginia Municipal Bond Commission for the period ending June 30, 2005, in accordance with section fifteen, article three, chapter thirteen of the code; which was filed in the Clerk's Office.
Mr. Speaker, Mr. Kiss, presented the annual report of the biennium for the fiscal years July 1, 2003 through June 30, 2005 for the West Virginia Board of Examiners for Licensed Practical Nurses, in accordance with section seven, article twenty-four, chapter thirty of the code; which was filed in the Clerk's Office.
Mr. Speaker, Mr. Kiss, presented the annual report of the West Virginia Disaster Recovery Board for the period ending June 30, 2005, in accordance with section twenty-seven, article five, chapter fifteen of the code; which was filed in the Clerk's Office.
Mr. Speaker, Mr. Kiss, presented the annual report of the West Virginia Department of Tax and Revenue of Classified Assessed Valuations Taxes Levied for the fiscal year ending June 30, 2006; which was filed in the Clerk's Office.
Mr. Speaker, Mr. Kiss, presented the 2004-2005 annual report of the West Virginia Parole Board, a Division of Military Affairs and Public Safety, in accordance with section twenty, article one, chapter five of the code; which was filed in the Clerk's Office.
Bills Introduced

On motions for leave, bills were introduced, read by their titles, and severally referred as follows:
H. B. 4014 -- "A Bill to amend and reenact §18-9A-8a of the Code of West Virginia, 1931, as amended, relating to the foundation allowance for regional education service agencies"; to the Committee on Education then Finance.
H. B. 4015 -- "
A Bill to amend and reenact §11B-2-20 of the Code of West Virginia, 1931, as amended, relating to funding of the Revenue Shortfall Reserve Fund"; to the Committee on Finance.
Miscellaneous Business

Delegate Hamilton addressed the House concerning the tragedy which occurred at the Sago Coal Mine, the media coverage and the dedicated and loving character of the persons involved in the rescue of the deceased miners.
At the conclusion of his remarks, all the members of the House arose in tribute.
Delegate Mahan then asked and obtained unanimous consent that the remarks of Delegate Hamilton be printed in the Appendix to the Journal.
Unanimous consent having been obtained, Delegate Moore offered a special prayer for the surviving families of the deceased coal miners and the earnest hope for the total recovery of the lone survivor, Randal McCloy, Jr.
