The Senate met at 6 p.m.
(Senator Tomblin, Mr. President, in the Chair.)
Prayer was offered by the Honorable C. Randy White, a senator
from the eleventh district.
Pending the reading of the Journal of Tuesday, March 16, 2004,
On motion of Senator Love, the Journal was approved and the
further reading thereof dispensed with.
The Senate proceeded to the third order of business.
The Clerk then presented communications from His Excellency,
the Governor, advising that on March 12, 2004, he had approved Enr.
House Bill No. 4484; on March 16, 2004, he had approved Enr. House
Bill No. 4108, Enr. Committee Substitute for House Bill No. 4273,
Enr. House Bill No. 4286, Enr. House Bill No. 4449 and Enr. House
Bill No. 4560; and on March 17, 2004, he had approved Enr.
Committee Substitute for Senate Bill No. 52, Enr. Senate Bill No.
268, Enr. Senate Bill No. 269, Enr. Senate Bill No. 324 and Enr.
Committee Substitute for Senate Bill No. 500.
The Senate proceeded to the twelfth order of business.
Remarks were made by Senators Deem and Minard.
Senator Bailey then moved that the Senate adjourn until
tomorrow, Thursday, March 18, 2004, at 6 p.m.
The question being on the adoption of Senator Bailey's motion,
and on this question, Senator Bailey demanded the yeas and nays.
The roll being taken, the yeas were: Bailey, Boley, Caldwell,
Dempsey, Edgell, Facemyer, Fanning, Harrison, Helmick, Jenkins,
Kessler, Love, McCabe, Minard, Minear, Plymale, Prezioso, Ross,
Snyder, Weeks, White and Tomblin (Mr. President)--22.
The nays were: Bowman, Deem, Hunter, McKenzie, Sharpe,
Sprouse and Unger--7.
Absent: Chafin, Guills, Oliverio, Rowe and Smith--5.
So, a majority of those present and voting having voted in the
affirmative, the President declared Senator Bailey's motion had
