     The House of Delegates met at 10:00 a.m., and was called to order by the Speaker.
     Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
     The Clerk proceeded to read the Journal of Thursday, February 20, 2003, being the first order of business, when the further reading thereof was dispensed with and the same approved.
     At the request of Delegate Staton, and by unanimous consent, the applicable provisions of House Rule 136, relating to privileges of the floor, were suspended for the day to extend privileges of the floor to invited guests for presentations by the House.
     At the request of Delegate Staton, and by unanimous consent, the House of Delegates proceeded to the Ninth Order of Business for the purpose of considering a resolution on Unfinished Business.
Unfinished Business

     The Clerk then read H. C. R. 46, requesting the West Virginia Division of Highways to name Mullens Overhead Bridge, located on State Route 16 in Mullens, Wyoming County, West Virginia, the "Sergeant Jack W. Staton Memorial Bridge".
     The question being on the adoption of the resolution, the same was put and prevailed.
     Ordered, That the Clerk of the House communicate to the Senate the action of the House of Delegates and request concurrence therein.
     At the request of Delegate Staton, and by unanimous consent, the House of Delegates then proceeded to the Seventh Order of Business for the purpose of introducing a resolution.
Resolutions Introduced

     Delegates Trump, Overington, Faircloth, Blair, Duke, Tabb and Mezzatesta offered the following resolution, which was read by the Clerk, as follows:
     H. R. 17 - "Commemorating and celebrating the life of Allen E. Goldstrom, husband, brother, U.S. Air Force veteran, teacher and public servant."
     Whereas, Allen E. Goldstrom was born on November 12, 1916 in Morgantown, West Virginia, to Andrew Oscar and Alice Rayner Goldstrom and was the brother of Andrew Oscar Goldstrom, Jr. and Harry Edward Goldstrom; and
     Whereas, Mr. Goldstrom was married to Virginia T. Goldstrom, who preceded him in death; and
     Whereas, Al Goldstrom loved the State of West Virginia. He was educated in public schools in Morgantown, graduated from Masontown High School in 1934, and acquired a Bachelor's Degree from West Virginia University in Morgantown. He was also a member of the West Virginia University Alumni Association and the Mountaineer Club; and
     Whereas, A life-long scholar, Mr. Goldstrom he had earned a Master's degree and had pursued doctoral studies; and
     Whereas, Mr. Goldstrom served as the Assistant Principal at Martinsburg High School. He was also a teacher with Morgan County Public Schools and served as the football and baseball coach before retiring in 1967; and
     Whereas, Mr. Goldstrom was a World War II veteran of the United States Air Force; and
     Whereas, Mr. Goldstrom was an active resident of his Berkeley Springs community, being a member of both the Francis Asbury United Methodist Church and the Deford Lodge #88 A.F. & A.M.; and
     Whereas, Mr. Goldstrom chose to reenter public service after his retirement and was elected to the House of Delegates in 1974, where he served as a member from 1975 to 1976; and
     Whereas, Allen E. Goldstrom, aged eighty-six, died Tuesday, January 7, 2003 at Morgan County War Memorial Hospital in Berkeley Springs; therefore, be it
     Resolved by the House of Delegates:
     That the House of Delegates hereby memorializes and celebrates the life of Allen E. Goldstrom and gratefully acknowledges his distinguished and dedicated career as a public servant to his country and his beloved state; and, be it
     Further Resolved, That the Clerk of the House of Delegates be hereby directed to forward a copy of this resolution to his surviving family members.
     At the respective requests of Delegate Staton, and by unanimous consent, reference of the resolution (H. R. 17) to a committee was dispensed with, and it was taken up for immediate consideration and adopted.

Resolutions Introduced

     Delegates Tabb, Anderson, Beach, Blair, Border, Campbell, Cann, Canterbury, Doyle, Duke, Evans, Faircloth, Foster, Long, Louisos, Manuel, Paxton, Perry, Schadler, Shaver, Stalnaker and Trump offered the following resolution, which was read by its title and referred to the Committee on Rules:
     H. C. R. 49 - "Requesting the Joint Committee on Government and Finance study the costs and benefits associated with West Virginia's deer population."
     Whereas, The State's deer population is an important economic resource of the State; and
     Whereas, The State benefits economically from the hunting of deer and associated activities; and
     Whereas, Residents and property owners in the State suffer financial losses due to property damage by deer, including crop damage and damage to vehicles; and
     Whereas, This may affect insurance rates for all West Virginians; and
     Whereas, With comprehensive detailed information concerning the costs and the benefits associated with the State deer population better decisions affecting the deer population may be made by the Legislature and executive agencies; therefore, be it
     Resolved by the Legislature of West Virginia:
     
That the Joint Committee on Government and Finance is hereby requested to comprehensively study the costs and benefits associated with the State's deer population; and, be it
     Further Resolved, The study should seek to identify and quantify not only the benefits the State receives from its deer population, but also the added costs and responsibilities to the State due to the presence of deer and how herd sizes may positively or negatively impact the identified costs and benefits; and, be it
     Further Resolved, That the Joint Committee on Government and Finance compile the results of the study into a report to be made available to the Legislature, executive agencies and the public; and, be it
     Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2004, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
     Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
     Delegates Fragale, Iaquinta, Warner and Cann offered the following resolution, which was read by its title and referred to the Committee on Rules:
     H. C. R. 50 - "Requesting the Commissioner of the Division of Highways to name the bridge crossing the West Fork River at Enterprise in Harrison County, the 'Corporal Jerry Lee Halpenny and PFC Michael Alonzo Wells Memorial Bridge'."
     Whereas, When this country needed its young men and women to serve in the Viet Nam War, two young men who lived only four houses apart in the town of Enterprise, Harrison County, faltered not in their duty as they saw it; and    
     Whereas, Corporal Jerry Lee Halpenny and PFC Michael Alonzo Wells brought honor to their families, their community and this State by their determination and unflinching courage in the face of terrible adversity and eventually laid down their lives in combat; and
     Whereas, While this State, Harrison County and the town of Enterprise lost a part of the future, the parents of Corporal Jerry Lee Halpenny and John and James Halpenny, his brothers, his wife Linda Halpenny Sandy and Alonzo Harvey Wells and Edith Irene Wells, the parents of PFC Michael Alonzo Wells, his brothers Charlie and James Harvey Wells lost their sons, a brother and a husband; and
     Whereas, Corporal Jerry Lee Halpenny was born on June 11, 1945 and died October 13, 1968 during his tour of duty in Viet Nam and PFC Michael Alonzo Wells was born February 7, 1949 and died June 27, 1969 during his tour of duty in Viet Nam; and
     Whereas, This country and the country of South Viet Nam awarded Corporal Jerry Lee Halpenny the Viet Nam Defense Medal, the Viet Nam Republic Medal, the Purple Heart, the Combat Infantry Medal, the United States Brass Medal, the United States Infantry Brass Medal, the Bronze Star and the American Defense Medal and it awarded PFC Michael Alonzo Wells the Viet Nam Republic Medal, the Purple Heart, the Bronze Star, the Bronze Star with Oak Leaf Cluster, a third Bronze Star, the Army Commendation Medal and the National Defense Medal; and
     Whereas, We know these two young men live in the hearts they have left behind, but they have honored all of us by their sacrifice and it cannot go unnoticed; therefore, be it

     An amendment, recommended by the Committee on the Judiciary, was reported by the Clerk, on page two, following the enacting section, by striking out the remainder of the bill and inserting in lieu thereof the following:
"ARTICLE 2I. WOMEN'S RIGHT TO KNOW ACT.
§16-2I-1. Definitions.
     For the purposes of this article, the words or phrases defined in this section have these meanings ascribed to them.
     (a) 'Abortion' means the use or prescription of any instrument, medicine, drug, or any other substance or device intentionally to terminate the pregnancy of a female known to be pregnant with an intention other than to increase the probability of a live birth, to preserve the life or health of the child after live birth, or to remove a dead embryo or fetus.
     (b) 'Attempt to perform an abortion' means an act, or an omission of a statutorily required act, that, under the circumstances as the actor believes them to be, constitutes a substantial step in a course of conduct planned to culminate in the performance of an abortion in West Virginia in violation of this article.
     (c) 'Medical emergency' means any condition which, on the basis of a physician's good faith clinical judgment, so complicates the medical condition of a pregnant female as to necessitate the immediate termination of her pregnancy to avert her death or for which a delay will create serious risk of substantial and irreversible impairment of a major bodily function.
     (d) 'Physician' means any medical or osteopathic doctor licensed to practice medicine in this state.
     (e) 'Probable gestational age of the embryo or fetus' means what, in the judgment of the physician, will with reasonable probability be the gestational age of the embryo or fetus at the time the abortion is planned to be performed.
     (f) 'Stable internet website' means a website that, to the extent reasonably practicable, is safeguarded from having its content altered other than by the department of health and human resources.
§16-2I-2. Informed consent.
     No abortion may be performed in this state except with the voluntary and informed consent of the female upon whom the abortion is to be performed. Except in the case of a medical emergency, consent to an abortion is voluntary and informed if and only if:
     (a) The female is told the following, by telephone or in person, by the physician or the licensed health care professional to whom the responsibility has been delegated by the physician who is to perform the abortion at least twenty-four hours before the abortion:
     (1) The particular medical risks associated with the particular abortion procedure to be employed; including, when medically accurate, the risks of infection, hemorrhage, danger to subsequent pregnancies, and infertility.
     (2) The probable gestational age of the embryo or fetus at the time the abortion is to be performed; and
     (3) The medical risks associated with carrying her child to term.
     The information required by this subsection may be provided by telephone without conducting a physical examination or tests of the patient, in which case the information required to be provided may be based on facts supplied by the female to the physician or other licensed health care professional to whom the responsibility has been delegated by the physician and whatever other relevant information is reasonably available to the physician or other licensed health care professional to whom the responsibility has been delegated by the physician. It may not be provided by a tape recording, but must be provided during a consultation in which the physician or licensed health care professional to whom the responsibility has been delegated by the physician is able to ask questions of the female and the female is able to ask questions of the physician or the licensed health care professional to whom the responsibility has been delegated by the physician.
     If a physical examination, tests or the availability of other information to the physician or other licensed health care professional to whom the responsibility has been delegated by the physician subsequently indicate, in the medical judgment of the physician or the licensed health care professional to whom the responsibility has been delegated by the physician, a revision of the information previously supplied to the patient, that revised information may be communicated to the patient at any time prior to the performance of the abortion procedure.
     Nothing in this section may be construed to preclude provision of required information in a language understood by the patient through a translator.
     

(b) The female is informed, by telephone or in person, by the physician who is to perform the abortion, or by an agent of the physician at least twenty-four hours before the abortion procedure:


     (1) That medical assistance benefits may be available for prenatal care, childbirth and neonatal care through governmental or private entities;
     (2) That the father, if his identity can be determined, is liable to assist in the support of her child based upon his ability to pay, even in instances in which the father has offered to pay for the abortion; and
     (3) That she has the right to review the printed materials described in section three of this article, that these materials are available on a state sponsored website and the website address.      The physician or an agent of the physician shall orally inform the female that the materials have been provided by the state of West Virginia and that they describe the embryo or fetus and list agencies and entities which offer alternatives to abortion.
     If the female chooses to view the materials other than on the website, then they shall either be provided to her at least twenty-four hours before the abortion or mailed to her at least seventy-two hours before the abortion by first class mail in an unmarked envelope.
     The information required by this subsection may be provided by a tape recording if provision is made to record or otherwise register specifically whether the female does or does not choose to have the printed materials given or mailed to her.
     

(c) The female shall certify in writing, prior to the abortion, that the information described in subsections (a) and (b) of this section, has been provided to her, and that she has been informed of her opportunity to review the information referred to in subdivision (3), subsection (b) of this section.


     

(d) Prior to performing the abortion procedure, the physician who is to perform the abortion or the physician's agent shall obtain a copy of the executed certification required by the provisions of subsection (c) of this section.


§16-2I-3.

Printed information.


     

(a) Within ninety days of the effective date of this article, the secretary of the department

of health and human resources shall cause to be published, in english and in each language which is the primary language of two percent or more of the state's population as determined by the most recent decennial census performed by the U.S. Census Bureau, and shall cause to be available on the website provided for in section four of this article, the following printed materials in such a way as to ensure that the information is easily comprehensible:
     (1) Geographically indexed materials designed to inform the reader of public and private agencies and services available to assist a female through pregnancy, upon childbirth, and while the child is dependent, including adoption agencies, which shall include a comprehensive list of the agencies available, a description of the services they offer and a description of the manner, including telephone numbers. At the option of the secretary of health and human resources, a 24-hour a day telephone number may be established with the number being published in such a way as to maximize public awareness of its existence which may be called to obtain a list and description of agencies in the locality of the caller and of the services they offer; and
     (2) Materials designed to inform the female of the probable anatomical and physiological characteristics of the embryo or fetus at two-week gestational increments from the time when a female can be known to be pregnant to full term, including any relevant information on the possibility of the embryo or fetus's survival and pictures or drawings representing the development of an embryo or fetus at two-week gestational increments:
Provided, That any such pictures or drawings must contain the dimensions of the embryo or fetus and must be realistic and appropriate for the stage of pregnancy depicted. The materials shall be objective, nonjudgmental and designed to convey only accurate scientific information about the embryo or fetus at the various gestational ages. The material shall also contain objective information describing the methods of abortion procedures commonly employed, the medical risks commonly associated with each procedure, the possible detrimental psychological effects of abortion and the medical risks commonly associated with carrying a child to term.
     (b) The materials referred to in subsection (a) of this section shall be printed in a typeface large enough to be clearly legible. The website provided for in section four of this article shall be maintained at a minimum resolution of seventy dots per inch. All pictures appearing on the website shall be a minimum of 200x300 pixels. All letters on the website shall be a minimum of eleven- point font. All information and pictures shall be accessible with an industry standard browser requiring no additional plug-ins.
     (c) The materials required under this section shall be available at no cost from the department of health and human resources upon request and in appropriate numbers to any person, facility or hospital.
§16-2I-4. Internet website.
     Within ninety days of the effective date of this article, the secretary of the department of health and human resources shall develop and maintain a stable internet website to provide the information required to be provided pursuant to the provisions of section three of this article. No information regarding persons visiting the website may be collected or maintained. The secretary of the department of health and human resources shall monitor the website on a daily basis to prevent and correct tampering.
§16-2I-5. Procedure in case of medical emergency.
     When a medical emergency compels the performance of an abortion, the physician shall inform the female, prior to the abortion if possible, of the medical indications supporting the physician's judgment that an abortion is necessary to avert her death or that a 24-hour delay will create serious risk of substantial and irreversible impairment of a major bodily function.
§16-2I-6. Protection of privacy in court proceedings.
     In every civil or criminal proceeding or action brought under this article, the court shall rule whether the anonymity of any female upon whom an abortion has been performed or attempted shall be preserved from public disclosure if she does not give her consent to such disclosure. The court, upon motion or sua sponte, shall make such a ruling and, upon determining that her anonymity should be preserved, shall issue orders to the parties, witnesses, and counsel and shall direct the sealing of the record and exclusion of individuals from courtrooms or hearing rooms to the extent necessary to safeguard her identity from public disclosure. Each such order shall be accompanied by specific written findings explaining why the anonymity of the female should be preserved from public disclosure, why the order is essential to that end, how the order is narrowly tailored to serve that interest, and why no reasonable less restrictive alternative exists. In the absence of written consent of the female upon whom an abortion has been performed or attempted, anyone, other than a public official, who brings an action under section nine of this article shall do so under a pseudonym. This section may not be construed to conceal the identity of the plaintiff or of witnesses from the defendant.
§16-2I-7. Reporting requirements.
     (a) Within ninety days of the effective date of this article, the secretary of the department of health and human resources shall prepare a reporting form for physicians containing a reprint of this article and listing:
     (1) The number of females to whom the information described in subsection (a), section two of this article was provided;
     (2) The number of females to whom the physician or an agent of the physician provided the information described in subsection (b), section two of this article;
     (3) The number of females who availed themselves of the opportunity to obtain a copy of the printed information described in section three of this article other than on the website;
     (4) The number of abortions performed in cases involving medical emergency; and
     (5) The number of abortions performed in cases not involving a medical emergency.
     (b) The secretary of the department of health and human resources shall ensure that copies of the reporting forms described in subsection (a) of this section are provided:
     (1) Within one hundred twenty days after the effective date of this article to all physicians licensed to practice in this state;
     (2) To each physician who subsequently becomes newly licensed to practice in this state, at the same time as official notification to that physician that the physician is so licensed; and
     (3) By the first day of December of each year, other than the calendar year in which forms are distributed in accordance with subdivision (1) of this subsection, to all physicians licensed to practice in this state.
     (c) By the twenty-eighth day of February of each year following a calendar year in any part of which this act was in effect, each physician who provided, or whose agent provided, information to one or more females in accordance with section two of this article during the previous calendar year shall submit to the secretary of the department of health and human resources a copy of the form described in subsection (a) of this section, with the requested data entered accurately and completely.      (d) Reports that are not submitted by the end of a grace period of thirty days following the due date are subject to a late fee of five hundred dollars for each additional thirty day period or portion of a thirty day period they are overdue. Any physician required to report in accordance with this section who has not submitted a report, or has submitted only an incomplete report, more than one year following the due date, may, in an action brought by the secretary of the department of health and human resources, be directed by a court of competent jurisdiction to submit a complete report within a period stated by court order or be subject to sanctions for civil contempt.
     

(e) By the first day of August of each year, the secretary of the department of health and human resources shall issue a public report providing statistics for the previous calendar year compiled from all of the reports covering that year submitted in accordance with this section for each of the items listed in subsection (a) of this section. Each report shall also provide the statistics for all previous calendar years, adjusted to reflect any additional information from late or corrected reports. The secretary of the department of health and human resources shall prevent any of the information from being included in the public reports that could reasonably lead to the identification of any physician who performed or treated an abortion, or any female who has had an abortion, in accordance with subsection (a), (b) or (c) of this section.


     (f) The secretary of the department of health and human resources may propose rules for legislative approval in accordance with the provisions of article three, chapter twenty-nine-a of this code which alter the dates established by subdivision (3), subsection (b), or subsection (c) or (e) of this section, or consolidate the forms or reports described in this section with other forms or reports to achieve administrative convenience or fiscal savings or to reduce the burden of reporting requirements, so long as reporting forms are sent to all licensed physicians in the state at least once every year and the report described in subsection (e) of this section is issued at least once every year.
§16-2I-8. Administrative remedies.
     (a) Any person or entity may make a complaint to the licensing board, if any, of a person whose conduct is regulated by the provisions of this article and may charge such person with a violation of this article.
     (b) Any physician or agent thereof who wilfully violates the provisions of this article is subject to sanctions by the licensing board governing his or her profession. For the first violation, the licensing board shall issue a written reprimand to the violator. For the second violation, the licensing board shall revoke the violator's license.
     (c) No penalty or civil liability may be assessed for failure to comply with paragraph three of subsection (b) of section two or that portion of subsection (c) of section two requiring a written certification that the female has been informed of her opportunity to review the information referred to in paragraph three of subsection (b) of section two unless the department of health and human resources has made the printed materials available at the time the physician or the licensed health care professional to whom the responsibility has been delegated by the physician is required to inform the female of her right to review them.
§16-2I-9. Civil remedies.
     
Any person upon whom an abortion has been attempted or performed without section two of this article having been complied with may maintain an action against the person who attempted to perform or did perform the abortion with a knowing or consciously, subjectively and deliberately formed intention to violate this article for compensatory damages. If the person upon whom an abortion has been attempted or performed without section two of this article having been complied with is a minor, the legal guardian of the minor may maintain an action against the person who attempted to perform or did perform the abortion with a knowing or consciously, subjectively and deliberately formed intention to violate this article for compensatory damages.
§16-2I-10. Severability.
     If any one or more provision, section, subsection, sentence, clause, phrase or word of this article or the application thereof to any person or circumstance is found to be unconstitutional, the same is hereby declared to be severable and the balance of this article shall remain effective notwithstanding such unconstitutionality. The Legislature hereby declares that it would have passed this article, and each provision, section, subsection, sentence, clause, phrase or word thereof, irrespective of the fact that any one or more provision, section, subsection, sentence, clause, phrase, or word be declared unconstitutional."

     On motion of Delegates Warner and Armstead, the Committee amendment was amended on page eleven, section seven, line eighteen, after the period, by inserting the following: "Any information that could reasonably lead to the identification of any physician who performed or treated an abortion, or any female who has had an abortion, in accordance with subsection (a), (b) or (c) of this section, is exempt from disclosure under the freedom of information act, article one, chapter twenty-nine-b of this code."

     Delegate Amores, Fleischauer, Palumbo, Webster, Manuel, Foster and Brown moved to amend the Committee amendment on page twelve, section eight, line five, by striking out all of section eight and inserting in lieu thereof the following:
"§16-2I-8. Evaluation and investigation of complaints.
     The West Virginia board of medicine or the West Virginia board of osteopathy, as the case may be, shall evaluate all information coming to its attention by complaint or from other sources alleging a violation of this article by a physician. If the information alleges facts that, if true, would constitute a violation of this article, the appropriate board shall docket a complaint and conduct an investigation. The board of medicine or the board of osteopathy shall also conduct an investigation and initiate disciplinary proceedings based on information received from peer review committees, physicians, hospital administrators, professional societies and others. The board of medicine or the board of osteopathy may initiate investigations on its own. Investigations and disciplinary proceedings shall be conducted in accordance with the provisions of section fourteen, article three or section twelve-a, article fourteen, chapter thirty of this code."
     On the adoption of the amendment to the Committee amendment, Delegate Foster demanded the yeas and nays, which demand was sustained.
     The yeas and nays having been ordered, they were taken (Roll No. 92), and there were--yeas 29, nays 69, absent and not voting 2, with the yeas and absent and not voting being as follows:

"§16-2I-9. Exemption from disclosure under provisions of freedom of information act.
     Information contained in the records and reports required by the provisions of this article is information of a personal nature as that term is used in subdivision (2), section four, article one, chapter twenty-nine-b of this code, and is specifically exempt from disclosure under the provisions of said article one."
     And,
     By renumbering the remaining sections.
     Delegate Fleischauer then asked and obtained unanimous consent that the foregoing amendment be withdrawn.

     "In any civil proceeding alleging a violation of this article, the identity of the female who alleges that an abortion has been attempted or performed and the identity of the physician or health care practitioner who allegedly performed or attempted to perform or assisted with an abortion shall be preserved from public disclosure unless consent is given to the disclosure, provided that this section may not be construed to conceal the identity of the plaintiff or of witnesses from the defendant."
     On the adoption of the amendment to the amendment, Delegate Webster demanded the yeas and nays, which demand was sustained.
     The yeas and nays having been ordered, they were taken (Roll No. 94), and there were--yeas 28, nays 69, absent and not voting 3, with the yeas and absent and not voting being as follows:

B. 170 - "A Bill to amend chapter sixteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new article, designated article two-i, relating to creating a Women's Right to Know Act; requiring informed consent for an abortion to be performed; requiring certain information to be supplied to women considering abortion; establishing minimum waiting period for abortions after having been supplied information; exception for a medical emergency; requiring physicians to report abortion statistics; requiring the secretary of the department of health and human resources to publish information and develop a website on alternatives to abortion; protecting privacy in court proceedings; exempting certain information from disclosure under the freedom of information act; administrative remedies; civil remedies; and penalties."

Second Reading

     
S. B. 205, Modifying criminal intent for animal cruelty crimes; fines; on second reading, coming up in regular order, was read a second time.
     An amendment, recommended by the Committee on the Judiciary, was reported by the Clerk and adopted, amending the bill on page three, section twelve, line six, following the word "knowingly", by striking out the word "or" and inserting in lieu thereof the word "and".
     And,
     On page three, section twelve, beginning on line twenty-two, following the word "reptile", by changing the period to a comma, and reinstating the stricken language to read as follows: "but in no case can recovery be had in excess of the assessed value of such dog, cat, animal or reptile."
     Delegate DeLong requested that the Journal record him as voting "Nay" on the adoption of the foregoing amendment.
     The bill was then ordered to third reading.
