A BILL to amend and reenact article 9, chapter 64 of the Code of West Virginia, 1931, as amended, relating to authorizing the West Virginia Pharmaceutical Cost Management Council to promulgate a legislative rule relating to pharmaceutical advertising expense reporting.

Be it enacted by the Legislature of West Virginia:

That article 9, chapter 64 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:

ARTICLE 9. AUTHORIZATION FOR MISCELLANEOUS AGENCIES AND BOARDS TO PROMULGATE LEGISLATIVE RULES.

§64-9-1. Pharmaceutical Cost Management Council

The legislative rule filed in the state register on the twenty-eighth day of July, two thousand six, authorized under the authority of section thirteen, article three-C, chapter five-A, of this code, modified by the West Virginia Pharmaceutical Cost Management Council
to meet the objections of the legislative rule- making review committee and refiled in the state register on the seventeenth day of January, two thousand six, relating to the Office of the Pharmaceutical Advocate (pharmaceutical advertising expense reporting, 206 CSR 1), is authorized with the amendment set forth below:
on page 2, subsection 3.1, line 1, by striking out the words "After the effective date of these rules" and inserting in lieu thereof the words "Effective July 1, 2008".

NOTE: The purpose of this bill is to authorize the West Virginia Pharmaceutical Cost Management Council
to promulgate a legislative rule relating to Pharmaceutical Advertising Expense Reporting.
