A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §18-5-47, relating to creating the Student and Family Privacy Protection Act.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §18-5-47, to read as follows:
ARTICLE 5. COUNTY BOARD OF EDUCATION.

§18-5-47. Student and Family Privacy Protection Act.

Each county board of education shall develop a policy requiring high school principals to inform each high school student, or the student's parent or legal guardian, of that student's right under Title IX of the federal No Child Left Behind Act of 2001 (20 U.S.C. 6301 et seq.) to request, pursuant to Section 7908 of Title 20 of the United States Code, that the student's name, address and telephone listing not be released to military service representatives without the prior written consent of the parent, legal guardian or student. A form shall be provided to the parent, legal guardian or student which clearly and conspicuously provides notice of the right to choose whether to disclose the information.
